This privacy policy (“Privacy Policy”) describes how World Comm Trading GFZ SRL, a company incorporated and operating according to the Romanian laws, with headquarters in Bucharest, 319 Splaiul Independentei Street, OB 209, ground floor, left, fiscal identification code RO16167421, registered at the Trade Register Office under no. J40/10819/2014 (referred to as „World Comm„, “us”, “we”), collects, stores, uses and discloses your Personal Data, as a controller, by giving access and providing our services through our website www.worldcomm.ro (the “Website”). Each time we are bound by the applicable law, we will request your free, informed, specific and explicit consent to process your personal data. By expressing your consent, you agree that we may collect, use, disclose, process and transfer your Personal Data, in accordance with this Privacy Policy.

By choosing to use our Website and services, you are expressing your freely given agreement on our policy stated within this page.

We reserve the right to change from time to time the provisions of this Privacy Policy. If we will make changes to this Privacy Policy, we will make available the updated version on the Website and we will update the date mentioned under „Last update”. We kindly ask you to constantly check this website page to ensure that you are informed regarding how your Personal Data will be used. Any changes to the Privacy Policy will apply from the date they were made and published on this page, excepting those changes that require your consent in advance and that will apply from the moment you expressed your consent.

1. Applicability

This Privacy Policy explains how we process our customers’ Personal Data, where World Comm is the Data Controller. This information note does not consider the processing carried out by World Comm partners.

Our Website may contain information about or links to partners’ websites that are outside our custody and/or control. We have no control over and assume no responsibility for the content, Privacy Policies or practices of any third-party websites, products or services. Please note that this Privacy Policy applies only to World Comm. Thus, we urge our customers to carefully read and review the privacy policies of each of those websites to get an understanding of how your personal data is being collected, stored, used and shared by those third-party websites.

2. Personal Data processed and purposes of processing

We use your Personal Data only in accordance with the applicable law. We do not collect or process sensitive data, as defined by the General Data Protection Regulation in the category of special personal data. We do not want nor is our intention to solicit and knowingly collect Personal Data of minors under the age of 16.

This section describes the purposes for which Personal Data are collected and processed by World Comm.

2.1. Website navigation data

On our Website, in addition to the Personal Data processed below, we may collect and store information in cookies and similar technologies, according to our Cookies Policy, that can be accessed on the dedicated page on our Website, https://worldcomm.ro/cookies-policy/

The computer systems and software applications used for the Website operation generally obtain some Personal Data (so-called „cookies”) and their transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified persons, but, due to their nature, may allow the user identification by processing and integrating with certain data stored by third parties. This information includes IP addresses, time of the request, used method for sending the request to server, file size obtained in response, as well as other parameters related to the user’s operating system.

We use this data only to obtain anonymous statistical information regarding the Website use and its proper functioning verification.

The legal basis for the processing of browsing data is our legitimate interest in improving the Website and maintaining it without errors, managing our server capacity and for security reasons regarding our systems.

2.2. Providing World Comm products and services, including through trading partners

The services that World Comm provides, including through trading partners, may be, but are not limited to:

  • processing orders (registration, validation, invoicing, shipping);
  • solving incidents of any kind regarding orders;
  • returning ordered products, partial or total, according to return policy;
  • reimbursing ruterned products;
  • answering requests/ notifications/ complaints.

In order to benefit from our products and services we will need the following Personal Data: name and surname, contact details (e-mail, phone number/s), delivery and billing addresses, desired products, invoicing details, payment method, returns of purchased products. Declining to provide these data, determines the impossibility, total or partial, to benefit from our services and products.

We will not collect or store any other information except those detailed above. Thus, we will not process your Personal Data regarding credit cards, your profile picture or any other details that you have shared with our business partners through your user account on their websites / applications.

The legal basis of these processing is the execution of the contract and the provision of our services. Also, in some cases the basis for processing this data is our legitimate interest in defending our business by taking measures to prevent and detect fraudulent attempts, including transmiting information to the competent public authorities, or measures to manage various other risks.

2.3. Commercial communications, surveys and marketing analysis

You have the option to receive commercial communications via e-mail and text messages, and to participate in surveys and marketing analysis related to World Comm products and services, in order to improve them. If you choose to receive such commercial messages, surveys and marketing analysis, we will use your first and last name, email address and / or phone number. We will send you messages containing:

  • general and specific information;
  • information regarding similar or complementary products to those you have purchased;
  • offers or promotions;
  • other commercial communications such as surveys and marketing analysis.

You may refuse to provide us with such data, to receive commercial communications from us, or to participate in surveys and marketing analisys.

If you have given your consent and changed your mind, or you want to update it, you can do so at any time and with no cost, by unsubscribing from the email list through the unsubscribe button included in any email received from us or by sending an e-mail to privacy@worldcomm.ro.

The legal basis for this processing is your freely expressed consent.

2.4. Selection of candidates for company jobs

World Comm publishes regularly job vacancies for selection and recruitment, jobs that are presented on the Website, on specialized recruitment platforms or on social networks. If you decide to apply for one of our available jobs, we will process your name and surname, your e-mail address and telephone number, home address, C.V. (curriculum vitae), data communicated during the interview, data related to previous professional experience, qualifications and employment history, vocational training, conferences and seminars, education, information included in diplomas, information related to background check (complying with applicable laws), search reports and recruitment firms reports. Declining to provide these data, makes it impossible to include you in our selection and recruitment process.

The purpose of this processing is to contact the candidates, interview them and hire them in our company.

The legal basis for this processing is the performance of a contract to which you are a party or in order to take steps at your request prior to entering into a contract.

2.5. Video surveillance

Video surveillance equipment is installed at World Comm headquarters. We process the video image by automated means in order to monitor people’s access and ensure their security and the security of World Comm buildings and assets.

The legal basis for this processing is our legitimate interest in ensuring security and safety in World Comm headquarters.

3. Storing and processing period

Generally, the duration of the processing of your Personal Data is:

  • Website navigation data will be kept for a period of up to one year;
  • data collected in order to provide World Comm’s services and products will be kept in accordance with legal requirements;
  • data collected for commercial communications, surveys and marketing analysis will be kept until your consent is withdrawn;
  • video recordings from surveillance cameras will be stored for up to 30 days;
  • data collected for selection and recruitment for one of our vacancies will be kept in accordance with the legal requirements for cases where there was an employment contract with us, or up to 6 months after the recruitment process ends for the job you have applied for, if you were not selected for the job.

In certain circumstances, we may retain personal data for longer periods of time, for example if we are required to do so in accordance with legal, regulatory, tax or accounting requirements.

We may also retain personal data for longer periods of time so that we have accurate records of your relationship with us in the event of any complaints or if we reasonably believe that there is a prospect of litigation related to the processing of personal data or transactions processed.

4. Transfer of Personal Data

We may employ third-party companies and individuals to help us operate our business. Our clients should know that these third parties have access to Personal Data to only help us and them perform our services. However, they are subject to strict contractual confidentiality obligations and are required not to disclose or use the information for any purpose other than providing our service.

We may transfer personal information to them, to the extent that this is necessary, to the following categories of recipients: group companies, contract partners, subcontractors, couriers, payment providers, archiving companies, authorized support centers, IT service providers, software or hardware vendors, market research companies, marketing companies, public authorities, court or arbitral tribunals, as well as competent authorities to investigate criminal offenses.

These third parties can be within European Union and/or European Economic Area. If they are located outside the European Union and the European Economic Area, including countries that are not recognized as providing an adequate level of protection, the transfer of personal information shall be made only if adequate safeguards are in place, in accordance with applicable law. For that, we rely on several safeguards, such as standard contractual clauses issued by the European Commission.

Upon request, you can receive from us a list of third parties from third countries, as well as a copy of the agreed provisions that ensure an adequate level of protection of Personal Data, at privacy@worldcomm.ro.

You may decide to use third parties’ websites and applications in connection to our services. For this case, we will share or disclose your Personal Data to your chosen third parties. Please note that we are not responsible for the privacy and security practices of the selected third parties’ websites and applications.

5. Security of Personal Data

The security of your Personal Data is important to us. Therefore, we maintain a variety of appropriate technical and organizational measures to protect your Personal Data from loss, misuse, and unauthorized access or disclosure. We limit access to Personal Data to employees who we believe reasonably need to retrieve that information to provide our services. Considering the current state of technology, we have implemented reasonable physical, electronic, and procedural safeguards designed to protect your Personal Data, such as limiting encrypting or anonymizing it or storing it on secure media.

No method of transmission over the Internet, method of electronic storage or other security methods are one hundred percent secure. Despite our best efforts, we cannot always guarantee the effectiveness of the security measures implemented, and therefore we cannot guarantee the absolute security of Personal Data.

6. Your rights towards the processing of Personal Data

Under the applicable law, you have the following rights:

Right of access: You have the right to obtain confirmation from us that your Personal Data are processed by us, as well as information on the specifics of processing, such as: purpose of processing, categories of data processed, recipients of personal data, period for which the data is kept, if it is transferred abroad and how we protect it, the source of your Personal Data.

Right to rectification: At any time, you have the right to request the rectification of your Personal Data. In the event of errors, after notification, we will immediately rectify your Personal Data.

Right to erasure: You have the right to request the deletion of Personal Data, provided that your request comply with applicable legal requirements. Personal Data will be erased when the legal requirements are met.

Right to restriction of processing: If the applicable legal provisions are met, you can request that we restrict the processing of Personal Data.

Right to data portability: If the applicable legal provisions are met, you have the right to provide Personal Data in a structured, commonly used and automatically readable format and the right to transmit it to another data controller.

Right to object: In certain situations, such as when we process Personal Data based on legitimate interest, you have the right to object to the processing of your Personal Data by us. In the event of unjustified opposition, World Comm is entitled to further process Personal Data.

Right not to be subject to decisions based solely on automated processing: If the applicable legal provisions are met, you have the right not to be subject to a decision based solely on automatic processing, including profiling, which has legal effects on you or affects you similar to a significant extent.

Right to address to the Supervisory Authority: You have the right to file a complaint with the National Authority for the Supervision of Personal Data Processing, in connection with any violation of your rights regarding the processing of your Personal Data. Consent withdrawal: To the extent that we process your Personal Data based on your given consent, you can withdraw your consent at any time, without affecting the legality of the processing based on the consent before its withdrawal.

Right to object to receiving commercial messages: You may also object to the processing of your Personal Data for the purpose of sending commercial messages.

7. Changes to our Privacy Policy terms

We have the right to change and update this Privacy Policy from time to time. Accordingly, we urge our users to review this page periodically to stay updated with how we use your Personal Data. If we are to change this Privacy Policy, we will make available on the Website the last updated version and we will update the date in the „Last update” section. Any changes to this Privacy Policy will be effective upon posting on this page, except the changes where your consent is expressly needed, which case the changes will apply from the date of your consent. In any case, continued use of our Website means that you agree to any updates or changes to this Privacy Policy.
